61875.13This paper provides an excellent overview of spousal support. It explores not only the historical roots of difficult spousal support conversations, but, also, a different approach to resolve potential conflicts over spousal support. This approach balances a rights-based analysis of spousal support with an integrative analysis of the clients’ needs, interests, and resources. Bringing interest-based negotiation into the spousal support arena enhances the possibility of creative and durable outcomes, and humanizes the pressing emotional needs of the players. 61875.09This paper reviews the law in Alberta applicable to common law relationships. Divided in various sections, this paper begins with the historical development of property rights for common law individuals followed by a review of the most recent Supreme Court of Canada decision (Kerr) and its subsequent interpretation. Next, Walsh and more recent case law as well as legislative responses in the various provinces are discussed. The author also examines spousal support entitlement, the Adult Interdependent Relationships Act, and, finally, the entitlements under provincial, federal legislation, and private rules. 61875.05In dialogue with the increasing trend of self-represented litigants, the purposes of this paper are: to review recent data regarding the participation of SRL’s in the court system (both from the perspective of lawyers and court workers); to assist the family law lawyer in understanding the different issues which may arise when dealing with the SRL; and to suggest various strategies to more effectively deal with the different types of SRL’s (with a view of decreasing time, aggravation, and expense).
