    The case of Jackson v Cooper, 2022 ABKB 609, was the first decision by Alberta courts to consider the Insurance Act amendments to the pre-judgment interest rates available for non-pecuniary/general damage awards in motor vehicle accident cases. This presentation examines Jackson, other jurisprudence, and legislation to help practitioners get a sense as to where the Alberta Court of Appeal may go with the amendments.     For personal injury lawyers, “business as usual” means advancing the interests of our clients, many of whom are seriously injured. Over the past nearly 20 years, part of that process has been to deal with the so-called “cap” on general damages for such clients, trying to marshal evidence that often includes proof of serious impairment taking injuries outside of the “cap”.
