When preparing an estate plan, it is important to carefully consider how assets are structured, that one’s estate planning documents are up to date, easy to locate and were created without any uncertainty. This paper explores the common types of estate litigation disputes including will challenges; personal representative’s conduct and disclosure; support and maintenance claims; joint assets and resulting trusts; and enforceability of domestic contracts.
