Family Law Considerations | Mark Demas
This session will explore how to advise clients on structuring gifts and inheritances to family members to protect them from being available for distribution on divorce. It will also examine the issue of whether child and/or spousal support continues to be payable on the death of one of the parties.

Family Maintenance and Support Considerations | Fiona Ellington
This session will identify and explore common disputes regarding who may be eligible to make a claim as a “family member” for the purpose of family maintenance and support applications in the context of a blended family. Review recent decisions involving blended families, the factors the court considered in determining whether the family member had received adequate maintenance and support from a deceased’s estate, and the methods used by the court to calculate any support payable to them.  This session will also explore considerations for estate planning for blended families, guided by the outcome of litigation of these issues.

EPAs and PDs | Erin Lafuente
In second marriages, loyalty, authority, and inheritance don’t always align. The individual holding decision-making power during incapacity may not be the one the client ultimately intends to benefit. Careful drafting of EPAs and Personal Directives can help prevent unintended disinheritance, conflict between step-parents and adult children, and costly litigation.
