Expansion to the Family and Divorce Filing Service – Court of King’s Bench of Alberta

The Court of King’s Bench of Alberta has recently announced further expansion of the King’s Bench Family and Divorce Filing Digital Service (“FDS”) to every judicial centre in Alberta. Effective May 15, 2023, it will expand to judicial centres in Grande Prairie, Wetaskiwin, Peace River, St. Paul, Fort McMurray, Medicine Hat, and Drumheller.

In all judicial centres in Alberta, the use of FDS will be mandatory for counsel filing a Statement of Claim for Divorce. Up until June 1, 2023, a two-week grace period will be granted to counsel, after which the use of the FDS will be strictly enforced by the courts.

The FDS currently does not accommodate filing where payment is waived, for from entities that do not pay a fee. Public interest practitioners should note that these filings will continue to be accepted by Email Filing.
