  • Tips, Traps, and Secrets in the Foreclosure Sale Process

    Designed from the perspective of lawyers acting for potential buyers, this paper outlines the foreclosure sale process generally. It also provides guidance to properly advise clients of the potential risks and other considerations when purchasing a property involved in a foreclosure proceeding. This paper was presented at LESA’s Foreclosures – Beyond the Basics webinar series in November, 2021.
  • Money in Court: Money You Never Knew You Had and How to Get It

    This paper discusses the process to have funds paid out of court after a foreclosure sale. It considers potential creditors in a foreclosure proceeding, priorities, and exemptions under the Civil Enforcement Act. It also discusses the implication of Crown claims, certificates of lis pendens, and builders’ liens on such funds. The paper includes a sample application, affidavit, and order to have funds paid out of court. This paper is part of a collection presented at LESA’s Foreclosure Fundamentals seminar in Edmonton on May 18, 2017 and in Calgary on May 23, 2017.  
  • Mortgage Basics

    This paper reviews the basics of mortgages for real estate transactions. It includes a discussion of common mortgage terms. It also provides an overview of the mortgage process when acting for the lender or when acting for the buyer, including receiving mortgage instructions, preparing documents, and requesting funds. Other considerations for dealing with mortgages, such as conflicts and fraud, are also discussed. This paper is part of a collection presented at LESA’s Real Estate Essentials program held in Edmonton on March 10, 2017 and in Calgary on March 17, 2017.
  • The Foreclosure Sale Process

    This paper provides a useful overview of the foreclosure sale process and distinguishes it from a standard closing sale. The purpose of the paper is to assist lawyers for the Buyer in understanding the risks involved in a sale within a foreclosure proceeding or after the financial institution has become the registered owner post-foreclosure. This paper was drawn from materials presented at the 45th Annual Refresher Course – Real Estate program held in May 2012.
