Most employment contracts include termination provisions which attempt to restrict the amount of notice or severance employees will receive upon termination, and restrictive covenants like non-competition and non-solicitation provisions that endeavor to restrain an employee’s post-employment activities. These provisions are not inherently enforceable. This presentation will assist practitioners with drafting enforceable separation, severance, and solicitation provisions, and with knowing what to look for when reviewing the validity of such provisions.
