It is incumbent on family law lawyers to use the summary trial process, where appropriate. Alberta courts are busier than ever. Too many clients do not understand the interim nature of interlocutory applications. This presentation explores what summary trials are and what they are not. It also addresses factors that lawyers need to consider when deciding whether a particular matter is appropriate for a summary trial. The presentation examines procedural similarities and differences between the Court of King’s Bench and the Court of Justice.
