Papers

  • Principles of Legislative Interpretation

Statutory interpretation is an art, the parameters of which are governed by the common law principles of interpretation and the Interpretation Act. Because it is an art, statutory interpretation provides fertile ground for effective advocacy. This paper explores the common law of statutory interpretation and the Interpretation Act. These materials are part of a collection presented at LESA’s Administrative Law program in Edmonton on February 24, 2026.
  • Advocacy in Administrative Law

Administrative law reflects the balance between the rule of law and the authority of parliament and legislatures to establish agencies and to endow them with broad powers. Good advocacy is as important in administrative law as in civil or criminal litigation. However, there are important differences and areas worth emphasizing that are unique to administrative proceedings. This paper considers the key principles of: statutory interpretation, advocacy in the context of adjudicative decision makers, advocacy for judicial review, and advocacy for appeals to court from administrative tribunals. This paper is part of a collection presented at LESA’s Alberta Litigation Institute program in Calgary on March 6–7, 2025.
  • Primer on Duty of Fairness

This paper provides an introduction to the rules of natural justice and the duty of fairness, which are essential to administrative law. Topics discussed include apprehension of bias in tribunal decisions, the impact of a breach of the duty of fairness, components of the right to a fair hearing, and more. This paper is part of a collection presented at LESA’s Administrative Law Fundamentals program in Edmonton on February 1, 2018 and in Calgary on February 8, 2018.
  • Primer on the Law of Evidence and Administrative Tribunals

This paper provides an introduction to the law of evidence in administrative matters. It considers both common law and statutory provisions relating to the rules of evidence, and provides practical suggestions for applying the rules of evidence when appearing before administrative tribunals. This paper is part of a collection presented at LESA’s Administrative Law Fundamentals program in Edmonton on February 1, 2018 and in Calgary on February 8, 2018.

Precedents are included.
This paper was presented at the Fundamentals of Judicial Review seminar in September 2014.
