Issues relating to expropriation of lands are becoming more common. Even before the Supreme Court of Canada decision of Annapolis Group Inc v Halifax Regional Municipality, there had been a noticeable push to test the boundaries of municipal liability in the planning and real estate context. This paper provides a broad overview of constructive taking and speculates on the application of Annapolis in the context of Alberta municipalities.
