Immigration Law: Consequences of Criminality

Criminal convictions can have significant consequences for permanent residents and foreign nationals. This paper reviews criminal inadmissibility under the Immigration Refugee Protection Act [IRPA], with a particular focus on ss 36 and 37 of the IRPA. It also discusses Section 44 reports, which are the initiating documents alleging inadmissibility of a foreign national or permanent resident, and provides tips for responding to a procedural fairness letter. As well, conviction and post-conviction options are discussed, including making an appeal to the Immigration Appeal Division.
