The use and disclosure of an employee’s medical information gives rise to many contentious issues in grievance arbitrations. This paper provides an analysis of the role of medical information at various stages of the sick leave or disability leave process, including short term disability leave, long term disability leave, and an employee’s return to work following an absence. The author provides a number of relevant case summaries.
