Alberta Courts Updates: Further Expansion to FDS and CCMS

The Court of King’s Bench of Alberta has announced further expansion of the King’s Bench Civil Digital Service (“FDS”) and Court Case Management Service (“CCM”).

Commencing December 6, 2023, FDS will accept all Commercial filings. All fillings previously offered in CCM will now be available with a new FDS filing category of “Commercial hearings.” This will include filings that were previously submitted via email and the CCM digital service. Materials filed in FDS for Commercial matters booked through CCM must be associated with the hearing no later than the previous Friday.

Effective December 6, 2023, all uncontested receivership hearing requests may now be submitted through the CCM digital service. This also applies to any new hearing requirements on already existing Commercial matters in Calgary and Edmonton. For a matter to be eligible for CCM filing, it must meet the following criteria:

  1. The hearing request must be for or related to receivership;
  2. The application must be uncontested;
  3. The matter must not be confidential;
  4. The hearing must be heard in Calgary or Edmonton;
  5. The matter must not be on a bankruptcy file.

CCM remains eligible for commercial matters commenced by way of Originating application. Contested receivership and all other commercial matter types will still be filed the conventional way.

Effective December 6, 2023, Government lawyers will have full functionality in CCM, including the ability to submit hearing requests, orders and associating materials to hearings. Government lawyers will also be eligible to digitize existing civil specials and participate in Commercial actions as both initiating counsel and action participants in CCM.
