Bankruptcy: Get an Overview of Business Insolvency and Personal Bankruptcy

In January, LESA is presenting a Bankruptcy seminar that will give an overview of both business insolvency and personal bankruptcy.

The co-chairs for this seminar are Calgary lawyers Craig McMahon of Field LLP and Jeffrey Oliver of Gowling Lafleur Henderson LLP. Craig has 11 years’ experience in commercial litigation with a specialization in bankruptcy and insolvency, restructuring, and creditor’s rights. Jeffrey, also with 11 years’ experience, practices in business bankruptcy and insolvency, and he acts for creditors, debtors, and court appointed officials.

“I find bankruptcy to be one of the most interesting areas of law because no two bankruptcies are the same,” explains Craig. “Bankruptcy may involve fraud, priority fights between creditors and a chess match by debtors, creditors and trustees.  But, at the end of the day, it is really all about money – who gets it and how much.”

Craig will introduce the personal bankruptcy process, the parties and key terms when he presents Bankruptcy 101. He will also give an overview on the topic of Bankruptcy and Fraud.

Jeffrey will present on the topic of CCAA Proceedings. His goal is to help attendees gain a better understanding of business-related insolvency proceedings.

“It was my intention that our topics would be of special interest to a wide scope of lawyers,” says Craig.  “For example, family lawyers will likely be very interested in the presentation on matrimonial law and bankruptcy. Civil litigators will likely be interested in the presentation on fraud. Tax and bankruptcy should be of interest to all attending because there are two certainties in life – death and taxes.  Bankruptcy can affect both of the certainties.”
