  • Allegations of Family Violence and Counter-Allegations of Alienation (On-Demand)

    Family violence cases are complex, and many factors contribute to their complexity. In addition, the alleged perpetrator often makes a counter-allegation of alienating behaviour. When these matters come to Court, often with limited and generally contradictory evidence, what can the Court do? This presentation explores these issues and provides options to consider when these matters arise. This on-demand program was originally presented as an in-person program on November 25, 2022 as part of our Addressing Family Violence in Chambers program. Total running time is 58 minutes.
  • Addressing Family Violence in Chambers Panel Discussion (On-Demand)

    This presentation consists of two panel discussions and includes answers to questions from attendees at the live session. The morning discussion focuses on the program’s first two topics: evidence in chambers and legal principles surrounding family violence. The afternoon discussion focuses on the additional topics of allegations of family violence, counter-allegations of alienation, and outcome options. This on-demand program was originally presented as an in-person program on November 25, 2022 as part of our Addressing Family Violence in Chambers program. The total running time for each individual presentation ranges between 1 hour, and 1 hour and 20 minutes.
  • Addressing Family Violence in Chambers (On-Demand)

    Most family law applications are dealt with in Regular or Special Family Chambers because an interim order is required and/or because the parties cannot afford a full trial or expert evidence. How then, can a family lawyer best make their client’s case regarding the presence of family violence in Chambers? What procedural steps must a lawyer be aware of in Alberta? What legal principles apply? What is the most recent caselaw on this issue? These presentations answer those questions and engage in thoughtful discussions about how to address family violence in chambers. These on-demand programs were originally presented as an in-person program on November 25, 2022 as part of our Addressing Family Violence in Chambers program. The total running time for each presentation ranges between 37 minutes to 1 hour, 20 minutes.
  • Child Protection Issues in Family Law Matters (On-Demand)

    Explore how to navigate parenting or divorce matters when Child and Family Services  (sometimes unexpectedly) becomes involved. These on-demand programs will help you to (1) navigate the initial involvement of CFS, (2) gather recent and past CFS information you may require in a parenting or variation application, and (3) represent a client filing a private guardianship application where the children are in the care of CFS. The total running time for each presentation ranges between 40 minutes and 1 hour, 5 minutes.
  • Private Guardianship Applications (On-Demand)

    This on-demand program explores private guardianship applications and child welfare in Alberta, with topics including private guardianship, application process, Cultural Connection Plan, and notice and consent. This on-demand program was originally presented on January 19, 2024 as part of our Child Protection Issues in Family Law Matters program.  Total running time is 40 minutes.

  • Applications for Guardianship of Children in Foster Care

    This paper examines the logistics of guardianship applications both before and after a PGO has been granted relating to a child in foster care. Contrasting applications under the Family Law Act with those under the Child, Youth and Family Enhancement Act, the author discusses the relevant case law and offers a look at both the funding issue and the processes. This paper was presented at the Child Welfare program in February, 2014.

    This paper examines new and noteworthy developments in family law for 2016. Topics discussed include changes to Maintenance Enforcement Program policies regarding section 7 expenses; applications for costs in family law litigation; dealing with self-represented litigations; imputing income for determining spousal support; and tips for handling social media in family law practice.
